December 19, 2006 , lizardmaster.com and Peta Todd...
I've had my fair share of controversy for this site, but this is the first time I've been asked to adjust it. Today, I received an e-mail.
Alex,
Please remove the folowing image from your site:
http://www.lizardmaster.com/UserFiles/Image/petatoddpregnant.jpg
It appears on this page:
http://www.lizardmaster.com/displaysearch.cfm?criteria=Peta
...and perhaps others.
It has been replaced with the image to the right. Removing any detail of the image that wasn't rightfully mine there before. I also revised my original post to no longer say that it was actually Peta Todd pictured left and to distinguish that the other posts refer to the People for the Ethical Treatment of Animals or PETA. The picture appeared no where else on the site.
As it stands it's a clear violation of the moral rights granted to
any and all artworks under U.S. and international copyright laws.
You're an expert at searches so it won't take you long to find the
application section of the Copyright Act. It basically states that
you don't have the right to post photos without permission especially
if you deface them.
Fair enough. Image completely removed from the server and replaced with the one to the right. Again, please visit Body in Mind for the real Peta Todd Pregnant. It really wasn't my intention to discredit Body in Mind or Peta Todd. I tried to point that out in my satirical post.
You may know that publishing photos without permission can be legal
if a photo is ruled by a court of law to be a satire but we both know
this photo is not a satire of anything. Peta is not famous enough to
justify being satirized, nor does your photo represent any political
or ideological challenge to "The Man".
According to Merriam-Webster: 1 : a literary work holding up human vices and follies to ridicule or scorn, 2 : trenchant wit, irony, or sarcasm used to expose and discredit vice or folly. I was going for the second definition to expose and discredit people hitting my site with the search key word. Unfortunately it appears that it's possible people could misread the original post as a satire of Peta Todd herself. That is not the intention, and the image has been fixed. See right.
Of course, I could threaten you with legal action but I'm counting on
you to remove it simply because it's a jeuvenile attack on a
beautiful young woman who is pregnant, and I don't think you really
want to stoop to the level of attacking pregnant women. (Not one of
your finer moments.)
I appreciate you not threatening me with legal action. Let's be adult about this. People who know TLM best know he doesn't want to do "jeuvenile attacks" on pregnant women. Thank you for allowing me to turn "not one of my finer moments" into a "finer moment."
I'll check again tomorrow to see if it's gone, and I hope for both
our sake's it is.
It is.
P.S. C=64 rules!
It does.
